ADOT FAST ACT Memo Regarding Milk Products

On December 4, 2015, President Obama signed into law the Fixing America’s Surface Transportation Act, or “FAST Act.”   ADOT is in the process of reviewing the FAST Act and is working towards the implementation necessary to align our state laws and regulations to comply with these Federal changes. One change is a provision that declares “milk products” to be a “non-divisible” load and therefore is eligible for an ADOT overweight permit. Below is the FAST Act provision on this subject:

SEC.1409 – Milk Products

Section 127(a) of title 23, United States Code, is amending by adding at the end of the following:

“13) Milk Products- A vehicle carrying fluid milk products shall be considered a load that cannot be easily dismantled or divided

In response to this new Federal provision, effective March 1, 2016,  ADOT will allow carriers who are hauling milk products to purchase an ADOT overweight permit to transport milk products over 80,000 pounds, but not to exceed axle weight limitations as set per Administrative Rule R-17-6-411.
