Below, please find a memo from the Department of Public Safety regarding the FMCSA’s Regional Emergency Declarations providing relief to those affected by the recent severe winter storms.

In short, it says that vehicles in Arizona are exempt from 49 CFR Parts 390 through 399 if they are providing direct relief for those states listed in the emergency declaration.

Subject: Regional Emergency Declaration

The Federal Motor Carrier Safety Administration (FMCSA) has issued a Regional Emergency Declaration due to severe winter storms across the nation.  The declaration provides an exemption from all of 49 CFR Parts 390 through 399 for all commercial vehicles providing direct relief for the winter weather emergency.  This includes, but is not limited to, the transportation of persons, supplies, goods, equipment, heating fuels, propane, natural gas, heating oil, and fuel products (including gasoline) used to provide necessary relief.  The exemption does not relieve drivers/motor carriers from compliance with Part 382 (Drug and Alcohol Testing, Part 383 (CDLs), Hazardous Materials Regulations, size and weight requirements, or local/state laws.  This exemption only applies to relief efforts that are on their way to, or returning from, the following states:  Arkansas, Connecticut, Delaware, District of Columbia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Minnesota, Mississippi, Missouri, Montana, Nebraska, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Dakota, Tennessee, Texas, Virginia, West Virginia, Wisconsin, and Wyoming.  The declaration will expire at 11:59 P.M. (ET) on March 4, 2021, unless further extensions are granted.  The official declaration is attached.
