The SMC will be meeting on Thursday, October 22nd at 2:00 in the training room at the ATA facility. This will be my last meeting as the Chair for the SMC. I will be hosting an open discussion on the “Top 20 Cargo Securement Out-of-Service Violations from 2014 Calendar Year in the U.S.” These violations represent over 80% of cargo related OOS violations and 13% of all OOS violations.
The election of the 2015-2017 SMC officers will also take place. It’s not too late to step up and get involved!
Hope to see everyone at the upcoming meeting.

The Scapellato & Company (Jodie and Jim) will be hosting a lunch and learn program on March 10th from 11:00 am to 1:00 pm. This is not a sales program; there is nothing to buy. Rather, it is strictly a safety program on a unique method to help truck drivers prevent rear end crashes into their tractor-trailer rig by other vehicles while stopped in the travel lane or shoulder of a roadway.
If safety is truly your # 1 priority, it is worth your time and effort to have lunch and see and hear what Jim Scapellato has to say. Jim Scapellato was formerly the Director of Research and Standards with the FHWA (now FMCSA). He was responsible for writing many of the interstate trucking rules we operate under today such as CDL, alcohol and drug testing, conspicuity, rear impact guards, medical qualifications, etc. He also served as the Director of Federal Enforcement Policy and Training, MCSAP grant program, and Hazardous Materials program. Prior to Washington D.C, Jim was the Southeast Regional Counsel in Atlanta, Georgia and prosecuted more than 3,000 motor carrier and driver cases for violations of interstate trucking rules but now helps carriers get their safety ratings upgraded and civil penalty claims dismissed or lowered.
The program will allow time for questions and answers and Jim and Jodie will be available after the program to meet with you. Jim will also be speaking briefly at the safety & maintenance council meeting later in the afternoon.

Ten years ago, motor carriers doing business in California could be confident they were legally compliant if their drivers followed DOT Hours of Service regulations. This is no longer the case, and two years ago the Ninth Circuit Court of Appeals held federal trucking law did not preempt California employment laws. Consequently, there have been waves of litigation against out-of-state motor carriers with drivers in California, resulting in multi-million dollar verdicts, concerning:
- California’s meal and rest break laws, governing when and for how long breaks must be provided and recorded;
- California’s piece-rate law, requiring each task to be separately paid at minimum wage or above; and
- California’s independent contractor laws, making it increasingly difficult to use ICs in California
Richard Rahm and Greg Coulter, Littler Mendelson, employment law co-counsel for the California Trucking Association, will discuss strategies for avoiding the legal pitfalls for any motor carrier with drivers in the Golden State.

Currently, there are four states that have passed the sale and use of marijuana for recreational use. Another four states have initiatives out for signatures that would replicate these changes in state laws for the November 2016 ballot. Arizona is one of those states. Since the passing of Amendment 64 in Colorado, states have been keeping their eye on the outcomes. Those that would like to see marijuana legalized have also used Colorado as the model state to reform future initiatives for other states.
The people of Arizona will likely be asked to vote yay or nah to legalize marijuana for recreational use this November. It is important that employers are well informed on what is in this initiative NOW, how the Colorado experiment has impacted employers and how Arizona's proposed language will directly affect the workplace.

On September 14, 2016 at 9:00 am Troopers from the Arizona Department of Public Safety's Commercial Vehicle Enforcement unit will be providing free training to representatives from various companies within Arizona's trucking industry.
The goal of this training is to have two to three representatives from your company attend the training and take what they have learned back to their companies and train their employees on the topics covered.
Troopers will cover how to maintain safe brakes, proper brake inspection maintenance and operation, what they look for during a commercial vehicle inspection, load securement, pre-trip inspections, and will take questions regarding inspections.

ATA has once again been invited by the Department of Public Safety to participate in the Annual Roadcheck event. Participants are able to observe inspections alongside officers at the designated areas as well as do ride-a-longs with officers.
This is a perfect opportunity to send your management staff, safety coordinators, technicians or other operational personnel to see first hand how inspections are done on a daily basis and learn how to improve your practices to become safer truckers!
The emphasis this year is cargo securement. According to CVSA, checking cargo securement is always a part of roadside inspections, CVSA is highlighting cargo securement as a reminder to drivers and carriers.

Safety is the top priority in the trucking industry today.
As you may know, the Arizona Transportation Education Foundation (ATEF), the ATA’s 501c(3), sponsors two major safety programs dedicated to educating the driving public on how to safety drive around a commercial vehicle. The first program called “Share the Road” is geared towards the general public. “Share the Road” events usually happen at large public gatherings like: Glendale’s Touch-a-Truck, TMC’s Be Safe Saturday, RoadCheck, etc. Our “Teens and Trucks” program, in partnership with DPS, generally takes place at high schools and middle schools and is geared towards teens just learning to drive.
Both programs are huge successes for the ATA and ATEF. Educating drivers about how to operate safely around large commercial vehicle benefits everyone!
Because these great programs are so successful, we have increased the number of events we do year over year. As a result, we need to recruit more companies to participate.
This is a great problem to have! The more people we can educate, the safer our roads will become… its as simple as that.
Therefore, I invite all carrier members to join us for a very special meeting with DPS Sergeant Corey Smith and Trooper Ed Warren to go over the Teens and Trucks school program!!Thursday - July 27th - 11:30am to 1:00pm

Operation Safe Driver Train-The-Trainer has been developed for the purpose of improving professional CMV driver behaviors. We will be hosting two (2) training sessions on August 31st. Morning class will be from 9AM to noon and afternoon class will be from 1PM to 4PM.
Five different training modules are included:

- Defensive Driving Part II
- Following the Rule of the Road
- Beyond Distracted Driving (Work Zones and Rural Roads)
- Defeating Distracted Driving
Each person in attendance will be provided a thumb drive that includes all of the material covered during the course.
Course Trainer, Randy West, is a retired Sergeant with the Utah Highway Patrol and has over 30 years of Commercial Vehicle Safety experience.

Bradshaw and Trooper Elmer will have a safety talk about pre trip inspections, levels of inspections, what troopers are looking for during inspections, etc. They will also do a walk around of a vehicle with everyone following a question and answer session.

CVSA’s Brake Safety Day is Sept. 7, 2017
Thursday, Sept. 7, 2017, is Brake Safety Day, an enforcement and compliance campaign where law enforcement agencies across North America will conduct inspections on large trucks and buses to identify out-of-adjustment brakes, and brake-system and antilock braking system (ABS) violations as part of the Commercial Vehicle Safety Alliance’s (CVSA) Operation Airbrake Program.
The goal of Brake Safety Day is to reduce the number of crashes caused by poorly maintained braking systems on commercial motor vehicles (CMVs) by conducting roadside mechanical fitness inspections, and identifying and removing vehicles with critical brake violations from our roadways.

The Pipeline and Hazardous Materials Safety Administration invites you to participate in a free one-day workshop that will provide you with a basic understanding of how to use the Hazardous Materials Regulations (HMR) and an overview of the many requirements for safely shipping and transporting hazardous materials.
The Hazardous Materials Regulations (49 CFR Parts 171-180) specify requirements for the safe and secure transportation of hazardous materials in commerce by rail car, aircraft, water vessel, and motor vehicle. These comprehensive regulations govern transportation-related activities by offerors (shippers, brokers, forwarding agents, freight forwarders and warehousers), carriers (common, contract and private), packaging manufacturers, re-conditioners, testers and re-testers, and independent inspection agencies. The HMR apply to any person who performs, or causes to be performed, functions related to the transportation of hazardous materials such as: determination of and compliance with basic conditions for offering, filling packages, marking and labeling packages, preparing shipping papers, and handling, loading, securing and segregating packages within a transport vehicle, freight container or cargo hold.
This one-day workshop is hosted by subject matter experts from the Hazardous Materials Safety Assistance Team under the U.S. Department of Transportation. Each workshop will include discussion topics on training requirements for hazmat employers and employees, security awareness requirements, packaging and labeling standards, placarding standards, proper shipping paper descriptions, and emergency response information. Anyone who is interested in learning more about hazmat transportation safety and the HMR is welcome to attend.

If you operate vehicles that require a CDL on the public roads and you have more than one employee in the company, you are required to get DOT Supervisor Training.
DOT Supervisor Training for Workplace Drug Abuse and Reasonable Suspicion is a Federal requirement for all supervisors of any DOT-regulated company personnel. This is a requirement by FMCSA 49 CFR Part 382.603.
This program fulfills the two (2) hours DOT supervisor training requirement regarding workplace drug and alcohol abuse awareness, but goes beyond this to ensure the proper procedures and documentation are used during the Reasonable Suspicion interview. A Certificate of Training is issued for the supervisors' personnel files. The three (3) hour live workshop will prepare Supervisors to take their new found knowledge and put it into practice immediately.
Registration deadline is 5PM November 25th.

ROADCHECK 2020 - September 9-10, 2020 , Flagstaff/Bellemont, AZ
Through our partnership with the Arizona Department of Public Safety, ATA is able to observe roadside inspections during this nationwide detail. This is a perfect opportunity for owners, management staff, safety coordinators, technicians or other operational personnel to see first hand how inspections are done on a daily basis. You will learn how to improve your practices to become safer truckers and/or gain first hand knowledge of the inspection process regarding truckers.
Our Carrier and Allied members are encouraged to attend, but you must sign up in advance!
There are two types of observations:
1) REST AREA OBSERVER - Observe the inspection process at the Parks Rest Area (located West of Bellemont, AZ). This give you a first hand look at the inspection process from A-Z. You will be able to shadow an inspector as they conduct inspections of various trucks stopped in the area.
2) RIDE ALONG WITH DPS OFFICER - We have a limited number of ride along position available for civilian observers. You will get the opportunity to ride with an officer and see what they see as they do their job paroling the highway. **This will require a background check. You must fill out and return the application and DPS liability waiver form. Only a limited number of slots will be available. You will be contacted once selections have been made.
Registration is FREE but necessary for each participate.
ATA would like to thank Diamond Trucking for once again opening their terminal this year for us use as a launching point for Roadcheck!

The Arizona Trucking Association (ATA) is excited to announce that we are hosting a special upcoming event to show appreciation for our professional truck drivers. The event is called battle of the states and the top 10 finishers will win cash prizes and qualify for the national “Battle of the States”. The competition will be a “Trucker Knowledge Competition” and it will be held virtually on Saturday, July 31st at 4:00 pm (AZ Time). While that might seem like an odd time to host an event, we are coordinating our efforts with many other state trucking associations around the country to hold similar competitions on the same night and at the same time – from Maine to Hawaii.
The concept is simple. We have subscribed to the quiz-show online platform called Kahoot to test professional drivers on their knowledge of trucking regulations, state-specific trucking details and we will also toss in some general trucking trivia to keep things interesting. Participants will register through the ATA to compete for cash prizes with entry requirements being very similar to those wishing to compete in our TDC. Again, the top 10 qualified finishers will also be eligible to compete at a similar national event hosted by the American Trucking Associations on August 14th.
This is meant to be a fun event for drivers, especially those who have missed the camaraderie and competition of the past two TDC’s. Part of this fun will be to compete for a number of significant cash prizes, thanks to the unbelievable generosity of the ATA Sponsors. For the past three winters a group of ATA members, and their friends, have traveled to Front Sight Firearms Training Institute, in Nevada, for four days of rifle and pistol training. These trips have been very educational and improved the firearm skills for everyone who has attended.
The trip also provides an exceptional opportunity to build friendships and bond with others in the industry. Those who chose to attend have the option of staying in a hotel in either Las Vegas or Pahrump, NV, but the majority of the attendees pack up a travel trailer, RV, or a tent and dry camp right outside the facility around a large campfire.
We want to invite you all to join us at Front Sight this year. Attendees will have the option of taking either the four day defensive pistol or the four day tactical shotgun class starting on Friday, November 5, 2021. (Note: Classes start early, so we will travel up on Thursday, November 4.)
I have 50 guess passes that allow one person to attend a four day class or allow two people to attend a two day class. These passes have a $2,000 face value, but I will be donating them and selling them off for $250 per pass. All proceeds will go to support the Arizona Transportation Education Foundation (ATEF). That's right, all proceed go to support ATEF.
Existing Front Sight members can attend for free. If you are an existing Front Sight member we want you to join us as well. You will have the option of attending the pistol class; the shotgun glass; or with the appropriate membership, you can sign up for the four day rifle marksman class. Existing members and guests, please be sure to sign up so we know you will be attending.
Please note: 1) you must be able to pass Front Sight's background check to attend classes. Please see course descriptions and requirements here four day defensive pistol requirements and four day tactical shotgun requirements. 2) There will be no refunds once the guest pass has been transferred to your account.

Officials from the Arizona Department of Transportation (ADOT) will give a presentation to ATA members on the Entry Level Driver Training (ELDT) rule via Zoom on Dec. 16 at 3 p.m.
The ELDT rule sets the baseline for training requirements for entry-level drivers. This includes those applying to:
- Obtain a Class A or Class B CDL for the first time.
- Upgrade an existing Class B CDL to a Class A CDL; or
- Obtain a school bus (S), passenger (P), or hazardous materials (H) endorsement for the first time.
The ELDT rule will become effective on Feb. 7, 2022. Use the link below to attend this presentation from ADOT, which will go over what the Entry Level Driver Training rule requires and allow you an opportunity to ask questions from the agency.

The Arizona Department of Transportation has two major projects underway that might affect how commercial truckers get in and out of the metro-Phoenix region for the next three years:
The I-17 Improvement Project will affect twenty-three miles of highway north of Phoenix, and the I-10 Broadway Curve Improvement Project affects eleven miles of central Phoenix, south and east of the downtown Phoenix area.
